The High Court today will be hearing submissions by all parties in to the case filed against the parole board's decision to release Member for North Malaita Jimmy Lusibaeain January this year.The case today will be the third hearing since the case went for mentioning on March 14. The High Court registry confirmed the case was set for 3:30pm this afternoon. The case had been filed by the deputy Opposition leader Matthew Wale against Police Minister James Tora, the parole board, speaker of Parliament Sir Allan Kemakeza and Mr Lusibaea.
This was after Mr. Lusibaea's two year nine months sentence imposed last year by the High Court was reduced to one month ony day, after Mr Lusibaea was granted 95 percent remission by the Police Minister. The sentence was reduced when he was released on licence on January 14.
Mr Wale filed the case to High Court last year challenging the decision by the Police Minister and the Parole board questioning the validity of the release. The Court hearing was adjourned on Monday for today when all submissions are expected to be heard by all parties.
The judge said there was an urgency to hear submissions from all parties regarding the matter and issues of representation before he could decide if the matter was to be heard before Parliament sits next week Monday.
The case is interesting because the final ruling will also determine whether Mr Lusibaea can still perform his duties as an MP?
